CUT COSTS AND SAVE MONEY IN TODAY'S TROUBLED ECONOMY

 

Can my employer cut my hours to part time so that I would be ineligible for health benefits? I’ve had cancer. ?

Can my employer cut my hours because they see my health as hurting the company’s insurance premiums? We’re trying to cut costs and needed to cut our insurance premiums. I’ve had cancer twice so I am a health risk. He has cut my hours to 20 so that I am not eligible for our health insurance plan. Do I have any rights in this case?

    If you’re not union and don’t have a contract, they can do whatever they want, including terminating you. Your relationship with your employer is "at will." If they want to end it, they can.

    I’d look around for another job, if I were you.

    If the employer cut your hours to save the medical premiums, and targetted you as a health risk, then that’s illegal.#

    However if several people are having hours cut, then you should consider whether the cuts are not personal, but connected to the business situation.

    You’ll need good proof if you want to claim that the employer has discriminated against you and deliberately cut your hours with the aim of eliminating you from the health plan.

    you have a legal right to file discrimination suit IF you can prove your employer’s actions were specifically targeted at eliminating YOUR insurance eligibility and as a direct result of your condition. a good lawyer would ask you to provide as much physical evidence as possible( e-mail, memos, audio recordings) to support your claim of discrimination. your employer will contend the cutback was based only on company finances(re-structuring). it sounds like discrimination but proving it will require some evidence. try to have credible witnesses if there are any. also try to get free consultation with a reputable lawyer. FIGHT HARD, GOOD LUCK!
